MurrKatz Maine Coon Kitten Contract!
MurrKatz Maine Coon Cattery and you agree to be bound by these terms, which you acknowledge that you have read and understood.
• Breeder guarantees that the cat being sold is a Pedigree Maine Coon cat.
• The kitten can go home between 12-14 weeks at which time 2 sets of FVRCP vaccines, Rabies vaccine and the health certificate have all been done by a certified Arkansas veterinarian.
• In the event the kitten has not been picked up or delivered by the 16th week birthday, then there is a $50 per day boarding fee for MurrKatz Cattery (paid in advance), plus any fees that may be required to keep vaccines updated, or for veterinary health care. The maximum time for boarding is 30 days.
Maine Coon Kittens are sold only as PETS
The buyer should take this kitten/cat to a veterinarian and have a complete health check within 5 business days.
• the buyer agrees to spay/neuter the kitten before it reaches its 9 month old birthday. The purchaser will receive the TICA or CFA Registration papers for the kitten within 7 days after proof of spay/neuter has been provided to the breeder and the final payment has been made on the kitten.
Health, Specific Conditions: Should the cat that is being acquired for your cattery be diagnosed with any of these specific health conditions
Hip Dysplasia; XRays must be evaluated by OFA and have a grading other than Excellent, Good or Fair]
HCM; must be diagnosed via echocardiogram by a board certified cardiologist.
If either of these conditions are reported, MurrKatz Cattery will replace the kitten at no charge once a written diagnosis by a licensed veterinarian has been provided, and the cat in question has been spayed or neutered and proof provided to the breeder.
• Kittens have a three year health guarantee (from the date of birth) against all genetic, congenital, and idiopathic health conditions. If any are found that ultimately result in the demise of the kitten, the Breeder will replace the kitten within the next three litters. There must have been a reasonable amount of effort taken by the Buyer to treat the condition and prevent the loss of life. What is “Reasonable” will be deemed by the Breeder.
• Accidental deaths are not covered in the health guarantee. This includes but is not limited to: eating something inappropriate, injury from another animal, self-injury, or any incident/accident that occurs.
• Until the kitten has reached its second birthday, MurrKatz Cattery will reimburse the buyer an amount up to $500 for any one veterinary bill that exceeds $1,299 and is the result of any genetic, idiopathic, or congenital health condition that is not caused from accident, neglect or carelessness by the owner and needs to be treated. An example of accident or neglect [but not limited to] would be harm caused by another animal, sprains, broken bones, or injury/accident.
• Infectious and/or contagious diseases such as but not limited to URI’s, FIV, FELV, Chlamydia, and Mycoplasma are not covered in this health guarantee.
• Proof of payment to the veterinarian must be provided in order to be reimbursed. MurrKatz Cattery has 30 days after proof of payment to reimburse the buyer.
• It is highly recommended for the Buyer to obtain pet insurance for their kitten/cat.
PERSONALITY
GUARANTEE
The buyer will have until the kitten's
6 month birthday to decide if the kitten has a desirable personality. If the buyer determines that he/she is unhappy with the personality of the kitten then:
Buyer will return the kitten to the breeder, at buyer's expense.
The kitten must be intact not
spayed neutered) when it's returned.
Breeder will replace the kitten within 12 months with another kitten. The replacement kitten will be between the age of 12 weeks old and the age of the original kitten when it was returned. Buyer pays for delivery of new kitten, if applicable.
Breeder offers one replacement kitten per lifetime.
RESPONSIBILITIES
Buyer agrees to keep vaccinations and health checks up-to-date, to provide a clean environment for your kitten, to never allow this cat to roam freely outdoors, to never place this cat in a shelter, and to never declaw the cat.
Purchasing a kitten from MurrKatz Cattery makes you solely responsible for the health and well-being of the kitten from the day it arrives at home until the last day of its life. It is not the responsibility of the breeder to pay for any veterinarian expenses, treatments, or medicines that may be required to improve the life of your kitten or cat other than what is covered in the health guarantee.
While everything is done to ensure that we deliver a healthy and viable kitten/cat, there's no way for us to predict the future health of any kitten. It is a living animal and there's always a risk that it may develop a health condition in the future.
BREACH OF CONTRACT
This contract is legally binding to all parties involved. This sales agreement is non-transferable to other parties.
Breach of this agreement will result in cancellation of any warranties, or guarantees, of this kitten. The Breeder's maximum liability to the Buver for any and all losses, claims, damages, or liability of any kind shall be limited to the amount paid by the Buyer to the Breeder under this agreement. Any lawsuits pertaining to this agreement will be handled in the state of Florida.
Breeder reserves the right to cancel this contract at any time prior to the kitten leaving the cattery. In that instance, the Buyer will be refunded 100% of their deposit and any other additional monies that have been paid.
REHOMING OF THE KITTEN OR CAT
In the event the kitten or cat must be rehomed, the Breeder has first rights to receive the kitten/cat back into their home and will happily oblige. All rehoming must be approved by MurrKatz Cattery.
The Buyer may be asked to deliver the kitten to the nearest airport. No refunds will be given to the Buyer in the event of rehoming.
